Contract provision addresses safeguarding workers on roofs with operating electronic equipment

Given the number of buildings with cell towers, satellite dishes and other equipment located on the roof, roofing contractors are likely to be called upon to perform roofing repairs or reroofing work on roofs with operating electronic equipment. Because of electromagnetic radiation, roof-located cell towers, satellite dishes and other electronic equipment present a dangerous safety and health hazard to personnel on the roof. Before accessing the roof, roof-mounted equipment should be identified with the building owner or property manager and a plan to ensure the safety of all personnel on the roof should be adopted and implemented. Personnel should not be on the roof, especially near operating electronic equipment.

Safeguarding workers on roofs with cell towers, satellite dishes and other electronic equipment: Owner shall shut down cell towers, satellite dishes and any other roof-located electronic equipment that emits or receives radio frequency waves when roofing personnel are on the roof so roofing personnel will not be subject to radio frequency waves or electromagnetic radiation when on the roof. Owner and its property manager shall indemnify and hold roofing contractor and its personnel harmless from any personal injury claims resulting from a failure by owner to do so.
